CLEAR RIVER KITCHEN TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the Clear River Kitchen website, online store, meal ordering services, pickup and delivery services, and related communications. By accessing our website, placing an order, or using our services, you agree to these Terms.

1. ABOUT CLEAR RIVER KITCHEN

Clear River Kitchen (“CRK,” “we,” “us,” or “our”) provides prepared meals and related food products available for online ordering, pickup, and, where available, delivery.

We reserve the right to modify our menus, pricing, ingredients, availability, pickup locations, delivery areas, ordering deadlines, and services at any time.

2. ONLINE ORDERS

All orders are subject to availability and acceptance by Clear River Kitchen.

Customers are responsible for providing accurate order, contact, pickup, and delivery information. We are not responsible for delays or failed deliveries caused by incorrect information provided by the customer.

Orders must be placed before the applicable weekly ordering deadline shown on our website. Once the ordering period has closed and food purchasing or production has begun, orders may not be eligible for cancellation or refund.

3. PRICING AND PAYMENT

Prices are displayed at the time of purchase and are subject to change without notice. Applicable taxes, delivery fees, and other charges will be displayed during checkout when applicable.

Payment is due at the time an order is placed unless otherwise expressly agreed by Clear River Kitchen.

4. ORDER CANCELLATIONS AND REFUNDS

Because our meals are prepared based on advance customer orders, cancellations and refunds may be limited once the weekly ordering deadline has passed.

If Clear River Kitchen is unable to fulfill an item or order, we may provide a replacement, store credit, or refund, as appropriate.

If you experience a problem with your order, please contact us as soon as possible so we can review the issue.

5. PICKUP

Customers are responsible for picking up orders during the designated pickup window communicated at the time of ordering.

Clear River Kitchen cannot guarantee the quality or safety of refrigerated or perishable food that is not picked up within the designated pickup period.

Orders not picked up during the scheduled window may be forfeited without a refund unless other arrangements have been approved by Clear River Kitchen.

6. DELIVERY

Delivery is available only within designated service areas and may be subject to minimum purchase requirements or delivery fees.

Customers are responsible for providing accurate delivery instructions and ensuring that someone is available to receive the order when necessary.

Once an order has been delivered to the location provided by the customer, the customer is responsible for promptly and properly refrigerating all perishable products.

7. FOOD SAFETY, STORAGE, AND REHEATING

Clear River Kitchen prepares and packages food according to our established food-handling procedures.

Customers are responsible for properly storing, handling, and reheating meals after pickup or delivery. Refrigerate perishable meals promptly and follow any storage, use-by, and reheating instructions provided with the product.

Do not consume a product if you reasonably believe it has been improperly stored, damaged, tampered with, or left outside safe temperature conditions.

8. ALLERGENS AND DIETARY INFORMATION

Clear River Kitchen prepares food in facilities where common food allergens may be present, including but not limited to milk, eggs, wheat, soy, peanuts, tree nuts, fish, shellfish, and sesame.

Although we may provide ingredient, allergen, or dietary information, we cannot guarantee that any product is completely free from allergens or cross-contact.

Customers with food allergies, sensitivities, or specific dietary requirements are responsible for reviewing available ingredient information before ordering and determining whether a product is appropriate for them.

9. MENU AND PRODUCT INFORMATION

We make reasonable efforts to accurately describe our meals, ingredients, portions, and products. However, ingredients and preparation methods may occasionally change based on availability or operational needs.

Product photographs are for presentation purposes and may not exactly represent the appearance, portion, packaging, or presentation of the product received.

10. SMS TEXT MESSAGE PROGRAM

By providing your mobile phone number and affirmatively opting in to receive text messages from Clear River Kitchen, you consent to receive recurring informational and marketing text messages, which may include weekly menu announcements, ordering reminders, pickup or delivery information, promotional offers, and other Clear River Kitchen updates.

Consent to receive marketing text messages is not a condition of purchasing any goods or services.

Message frequency may vary. Message and data rates may apply.

You may opt out of marketing text messages at any time by replying STOP to a message. You may reply HELP for assistance where supported.

Carriers are not liable for delayed or undelivered messages.

Your participation in our SMS program is also subject to any additional disclosures presented when you subscribe.

11. EMAIL AND MARKETING COMMUNICATIONS

If you choose to subscribe to our marketing communications, we may send you information about menus, products, promotions, and business updates.

You may unsubscribe from marketing communications using the unsubscribe method provided in the applicable communication.

12. WEBSITE USE

You agree not to misuse our website, interfere with its operation, attempt unauthorized access, submit fraudulent orders, or use our services for unlawful purposes.

All website content, branding, logos, photographs, graphics, menu descriptions, and original materials owned by Clear River Kitchen may not be reproduced or used for commercial purposes without our permission.
